General Terms and Conditions (GTC) 



0. GENERAL

These General Terms and Conditions (GTC) govern the legal relationship between the hotel guest and Hotel de Londres, hereinafter referred to as the “Hotel”.

Hotel de Londres reserves the right to apply different provisions, particularly regarding cancellation conditions and prices, provided these are clearly stated in the offer or booking confirmation.



1. SCOPE

These General Terms and Conditions (GTC) apply to the provision of hotel rooms and meeting rooms, as well as to the use of public areas and all other related services and supplies provided by the Hotel.

All offers and confirmations issued by the Hotel are based on these GTC. They form an integral part of every contract.

The Hotel reserves the right to amend these GTC and publishes the current version on the Hotel’s website. The version of the GTC valid at the time the contract is concluded shall apply to the respective contract.

Individual amendments to these GTC require an express written agreement between the parties.



2. CONCLUSION OF THE CONTRACT

The contract between the parties is concluded directly upon reservation of a hotel room or meeting room.

The booking confirmation is issued via the respective booking channel and is binding.



3. SERVICES, PAYMENTS & PRICES


3.1

The Hotel undertakes to provide the services ordered by the guest and confirmed in writing by the Hotel.


3.2

All prices are quoted in Swiss francs (CHF) and include statutory value added tax (VAT).


3.3

For hotel room reservations, the Hotel is entitled to pre-authorise the full amount or the amount of the first night.

If the authorisation is unsuccessful, the Hotel is entitled to withdraw from the contract after granting a reasonable additional period for payment. The guest shall be liable for any resulting loss or damage.


3.4

Unless a deposit is required, the full invoice amount must be paid by the guest no later than the time of departure by credit or debit card or in cash.

Where payment by invoice has been agreed, the full invoice amount is due 10 days after the invoice date.

In the event of late payment, the Hotel is entitled to charge default interest of 5% as well as any debt enforcement and collection costs.


3.5

Price changes remain reserved until the contract is concluded. Once the contract has been concluded, the prices agreed in the booking confirmation or offer shall apply.



4. LIABILITY


4.1

The guest shall be liable to the Hotel for damage and losses caused by the guest or by persons for whom the guest is responsible.

In the case of meetings, seminars and events, the contracting party shall also be liable for damage caused by its employees, participants, agents or third parties engaged by it, insofar as such damage is attributable to its area of responsibility.

Insurance for items brought onto the premises for meetings, seminars or events is the responsibility of the contracting party. Where necessary, the Hotel may require proof of appropriate insurance.


4.2

The guest is required to maintain peace and order and to comply with the house rules. Instructions issued by the Hotel for the purposes of safety and the proper operation of the Hotel must be followed.


4.3

The Hotel shall be liable for damage in accordance with the statutory provisions.

To the extent permitted by law, the Hotel’s liability for slight negligence is excluded. Liability for indirect and consequential damages, in particular loss of profit, is excluded to the extent permitted by law.

Mandatory statutory liability provisions remain unaffected.


4.4

In the event of damage to, destruction or theft of items brought into the Hotel by overnight guests, the statutory provisions governing the liability of innkeepers pursuant to Art. 487 et seq. of the Swiss Code of Obligations (CO) shall apply.

Damage to items brought into the Hotel must be reported to the Hotel immediately upon discovery.

For items brought into the Hotel in connection with meetings, seminars or events, the Hotel shall be liable within the scope of the statutory provisions. The contracting party is responsible for ensuring that such items are adequately insured.



5. WITHDRAWAL BY THE HOTEL


5.1

The Hotel is entitled to withdraw from the contract in whole or in part if the provision of the agreed services becomes impossible or unreasonable for reasons for which the Hotel is not responsible, or if there is good cause.


5.2

Good cause shall include, in particular, force majeure or other circumstances beyond the Hotel’s control which make performance of the contract in whole or in part impossible or substantially more difficult. These include, in particular, natural events, fire, war, civil unrest, official orders or restrictions, strikes, epidemics, pandemics and significant disruptions to the supply of energy, water or other utilities necessary for the operation of the Hotel.

In such cases, the Hotel is entitled to withdraw from the contract in whole or in part. Payments already made for services which are not provided as a result of the withdrawal will be refunded. Further claims by the guest are excluded to the extent permitted by law.


5.3

The Hotel is also entitled to withdraw from the contract for good cause or to terminate the contract with immediate effect. Good cause shall exist in particular where there are reasonable grounds to believe that the guest, participants or third parties attributable to the guest may significantly impair or endanger the smooth operation of the business, the safety of persons or property, or the reputation of the Hotel.

The same applies in particular if the guest breaches material contractual obligations, fails to make agreed payments or provide security when due, or has provided materially false or misleading information when making the booking.

The Hotel reserves the right to claim damages.



6. WITHDRAWAL BY THE GUEST


6.1

Withdrawal by the guest is generally governed by the cancellation provisions set out in section 10 of these GTC.


6.2

The price stated in the booking confirmation (including VAT) shall be decisive for calculating the cancellation costs of the individual services.



7. MAKING RECORDINGS

Visual and/or audio recordings of any kind (such as photographs or videos) for commercial purposes on the Hotel premises are prohibited and require the Hotel’s express written consent as part of an appropriate agreement.

Requests must be submitted to the Hotel at freunde@hotel-delondres.ch, stating the person creating and publishing the material (client), the specific intended use (product/service to be marketed, publication medium) and any further relevant information (concept).

If recordings are made without the corresponding written consent, the Hotel is entitled to withdraw from the contract. The guest shall be liable to the Hotel for any resulting loss or damage.



8. ARRIVAL & DEPARTURE TIMES

Hotel rooms are available from 3.00 pm on the day of arrival and must be vacated by 11.00 am on the day of departure.



9. GROUP BOOKINGS / ROOM ALLOTMENTS


9.1

For group bookings of 5 rooms or more (hereinafter referred to as “group bookings”), the organiser must provide the Hotel with a binding list of participants (hereinafter referred to as the “participant list”) no later than 14 days prior to arrival, containing the following information:

  • First and last names of the guests
  • Email address
  • Guests’ payment terms
  • Where possible, dates of birth and identification document numbers, including the date of issue of the document


9.2

If the organiser has booked a room allotment and the participant list submitted does not fully utilise the allotment (or if no participant list is submitted within the stipulated period), the remaining rooms in the respective allotment will be released for general sale.



10. CANCELLATION CONDITIONS

Different cancellation conditions apply depending on the hotel room rate booked.

The following cancellation conditions apply to bookings made directly (via the Hotel website, by telephone, email or in person).
For bookings made via another booking platform, the respective conditions shall apply.


10.1 Standard Rate

The flexible Standard Rate may be cancelled free of charge until 12 noon (local time) on the day before arrival.

In the event of a later cancellation or no-show, the booked services will be charged.


10.2 Non-refundable Rate

This reduced rate (e.g. “Early Bird Special”) must be paid at the time of booking and cannot be cancelled free of charge at any time.


10.3 Long-stay Rates


Stays of 7 to 14 nights

The reduced Long-stay Rate is charged for the entire stay at the time of booking.

Cancellation free of charge is possible until 12 noon (local time), 7 days prior to arrival. In this case, the amount already paid will be refunded.

In the event of a later cancellation, no-show or early departure, the entire booked stay will be charged.

Stays of 15 nights or more

For stays of 15 nights or more, cancellation free of charge is possible until 12 noon (local time), 21 days prior to arrival. In this case, the amount already paid will be refunded.

In the event of a later cancellation, no-show or early departure, the entire booked stay will be charged.

For group bookings, meetings, seminars and events, the cancellation and payment conditions agreed in the respective offer or booking confirmation shall apply. These take precedence over the general cancellation and payment conditions of these GTC.



11. REBOOKING BY THE HOTEL

If, for any reason, the Hotel is unable to provide the guest with one or more booked rooms, the guest will be provided with an equivalent room.

If the Hotel is unable to provide a suitable room, payments already made for services not provided will be refunded. Further claims are excluded to the extent permitted by law.



12. EVENTS

All requests for events (seminars, meetings, aperitifs, breakfast, brunch) must be submitted by the guest in writing.

The guest will receive an individual offer in response to the request. All relevant conditions, including payment and cancellation conditions, will be clearly stated in the offer.



13. PETS / NO SMOKING

Pets are not permitted in the Hotel.

Smoking is prohibited in all indoor areas of the Hotel. In the event of a breach of the smoking ban, the guest will be charged for any resulting cleaning, restoration and other consequential costs.



14. SEVERABILITY CLAUSE

Should individual provisions of these GTC be or become wholly or partially invalid, the validity of the remaining provisions shall remain unaffected.



15. APPLICABLE LAW / PLACE OF JURISDICTION

The contract shall be governed exclusively by Swiss law.

The place of performance and jurisdiction is Brig.
